By accessing or using SentinMail ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

SentinMail is an email builder and campaign management platform that allows you to design responsive emails, manage subscriber lists, create and send campaigns, and track email engagement. The Service operates on a "bring your own SMTP" model — you provide your own email sending infrastructure.

3. Account Registration

To use the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be at least 18 years of age or the age of majority in your jurisdiction

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

Send unsolicited bulk email (spam) or violate anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
Send emails containing malware, phishing links, or fraudulent content
Harvest email addresses or personal data without consent
Impersonate any person or entity
Interfere with or disrupt the Service or its infrastructure
Violate any applicable local, state, national, or international law
Upload or distribute content that is illegal, harmful, or infringes on intellectual property rights

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Email Sending and Compliance

You are solely responsible for ensuring your email campaigns comply with all applicable laws and regulations, including but not limited to CAN-SPAM, GDPR, and CASL. This includes:

Obtaining proper consent from recipients before sending
Including a valid physical mailing address in campaigns
Providing a clear and functional unsubscribe mechanism
Honoring unsubscribe requests promptly

SentinMail provides tools to assist with compliance but does not guarantee compliance on your behalf.

6. Subscription and Billing

Paid plans are billed on a recurring basis (monthly or annually) as selected at checkout. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or downgrade of your account.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by SentinMail and protected by intellectual property laws. You retain ownership of the content you create using the Service (email templates, subscriber data, campaign content).

You grant us a limited license to process and store your content solely for the purpose of providing the Service.

8. SMTP Configuration

You are responsible for the configuration and security of your SMTP servers. SentinMail is not liable for email delivery failures, bounces, or reputation damage caused by misconfigured SMTP settings, blacklisted IPs, or issues with your email infrastructure.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

To the maximum extent permitted by law, SentinMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

Either party may terminate at any time. You may delete your account through your account settings. We may suspend or terminate your access for violation of these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
